Seller agreed to a refund. He repaired it and sent it back with new batteries instead. In the interim, my friend who I bought it for, bought one on her own as we are too far into the ski season to wait. This was a gift for her. Now I am out by $70 and stuck with a thermometer that I don't need. This will be my very first and very last experience with e-bay.
