    I apologize about this. This item was listed as being defective due to the battery not charging. It was in the biggest font at beginning of description as being defective due to not charging and also under the condition it sates the condition of the item being defective due to batteries won't charge. I did not list the item as new and indeed made it clearly visible with the biggest font in listing the condition of the defective batteries.
