Vicks Comfortflex Digital Thermometer - Use for Oral, Rectal or Under the Arm

My Thermometer wasn´t NEW, wasn´t sealed!!!

The ad says PRODUCT NEW, but I received my Thermometer with the PLASTIC PACKING VIOLATED and may I be wrong, but the battery look´s like already used, because the screen is turning off when the display change the color, the numbers disappear. I saw one of these working and this blackout didn´t occur.
