The Supreme Court: Our Legislative Branch of Government
Kevin Gutzman takes the reader on a journey that traces the evolution (or better, "devolution") of the Supreme Court that begins with the musings of Thomas Jefferson and ends with the disputed Bush-Gore election of 2000. Pointing out the fallacious reasonings of the Marshall court, Gutzman reveals the ongoing naked, undemocractic power grasp of the Supreme Court from its inception. This book does not come across to me as partisan at all, however, which was a bit of a surprise and relief. The defunct Federalist party takes a beating, but so do its heirs in both the Democrat and Republican parties. Both of our current unhappy parties share the blame for failing to protect the Constitution from those who have misinterpreted it and turned it into a rubber stamp to promote whatever flavor of the day agenda that its abusers want it to promote. The Supreme Court clearly sees itself as both the judicial AND the legislative branches of our government. One can scarcely believe all the hidden principles that its abusers have found within its very brief text. In addition to the Supreme Court, "sacred cow" presidents like Lincoln and FDR are stripped clean and laid bare as well by Gutzman's penetrating analysis. This is the perfect book for the "Politically Incorrect" series as it will be a source of annoyance for many people who are a source of annoyance to me. The only beef I have with the book is that certain chapters were much stronger than others, and Gutzman covers so many Supreme Court cases that he tends to gloss over some of them. But I would recommend this book heartily. Read it and join me in beating your head against the wall when you read all the ways that the 14th amendment (the "magic genie" amendment) has been interpreted since its inception.
