New in Box means opened
I was glad to find this tripod since they are no longer made. It's a solid tripod and replaced my old broken one perfectly. I am disappointed in the packaging. "New in box" had been opened and smelled of musty mold. The larger box the original box was packed in was too large and not packed so the packing box can opened and crushed on one end. Thankfully the tripod was not damaged.
